This bill runs afoul of due process, punishes association, is unnecessary, and will almost certainly chill protected speech. Existing law already prohibits trespass and malicious destruction of property. Given that, SB 471’s focus on critical infrastructure facilities contradicts its neutral purpose—as do its excessive fines. The bill would further stifle free speech and protesting rights by slapping any organization “found to be a conspirator” of a trespassing protester with a heavy fine.
