These bills would give the attorney general the authority to sweep in and demand information from nonprofits with what the attorney general deems as “reasonable cause”. If the nonprofit does not provide the information demanded, the attorney general can petition the courts to shut the nonprofit down. Although SB 278 does allow a nonprofit to petition the court to determine whether the request for information is actually reasonable, it would still create an unnecessary burden. The ACLU of Indiana opposes legislation that gives the attorney general this kind of extensive power over local nonprofits.
