This bill limits charitable bail organizations from functioning in Indiana by enacting unattainable requirements. The bill will require a charitable bail organization to register with the Department of Insurance, hire a bail agent, pay fines, fees, and costs, among other requirements. The version passed doesn’t place a cap on bail amounts that can be paid, but prohibits a charitable bail fund's ability to bail people out who have been charged with a violent offense, or have any previous violent conviction--no matter how old. These limitations violate charitable bail organizations’ First Amendment rights and rights under equal protection.
