A judge granted the ACLU of Indiana’s request for a preliminary injunction against the Indiana Department of Homeland Security (DHS) on behalf of Next Step Recovery Homes (Next Step).

Our federal complaint, filed today, challenges a change in policy by the Indiana Family and Social Services Administration (FSSA) that threatens the safety and well-being of medically complex children.

The law requires competency restoration services be provided to people who are found incompetent to stand trial, but this is not happening in some cases in Indiana county jails, leaving these individuals sitting in jails without access to necessary services.
