The case alleges that two, as of yet unknown, Indianapolis Metropolitan Police Department officers with the assistance of the Indianapolis Department of Public Works removed and destroyed all the property of five homeless persons who were staying underneath a railroad overpass. 

According to the lawsuit, on Monday, December 17, two on-duty IMPD officers, with no prior notice and without cause, removed five individuals’ properties and destroyed the possessions without affording them an opportunity to reclaim their property. Officers collected and destroyed, not only clothing, bedding and tents, but plaintiffs’ prescription medication as well. The case alleged a violation of the Fourth Amendment and due process.

The case was dismissed.
